Care of WA’s environment by providing individuals and community groups with environmental legal services including advice, education, representation and opportunity to participate in reform of laws affecting the environment. In the early 1990s dos were established in Victoria and Queensland. The EDP appears in numerous cases in the WA Mining Warden’s Court, successfully expanding standing of public to object to mining tenements. EDP is a finalist in the WA Environment Awards. EDP is again a finalist in the WA Environment Awards. EDP begins work on Climate Change and Energy Law project. During much of the year, the EDP assists community groups who win in turning back efforts to mine coal in Margaret River. EDP represents Sea Shepherd and others in WA Supreme Court action that sought, unsuccessfully, to quit WA Premier’s controversial shark drum line program though EDP loses, Court agrees action was in the public interest and does not award costs to the State. EDP also appears in 2 WA State istrative Tribunal proceedings, on behalf of rural residents of York Shire opposed to Nita’s proposed municipal waste landfill close Mt Observation NP, and on behalf of other rural landowners opposed to expansion of sand mine close Ellen brook. The EDOWA can only work to help the WA community and environment through your abundant donations.

Protection of WA’s environment by providing individuals and community groups with environmental legal services including advice, education, representation and opportunity to participate in reform of laws affecting the environment. Teamwork comes naturally because everyone involved wants to be here. Volunteering at the EDP has provided me with an opportunity apply the skills I learn at law school to aid a diverse group of people protect the environment. Upon my return to Western Australia, I continued to labor for a period for a junior oil and gas company. We would not be thriving without the commitment of outstanding and passionate people, dedicated to protecting WA's environment. The legal practice is managed by a Principal Solicitor, who is assisted by staff and volunteers. Alex Gardner is a Professor of Law at the University of Western Australia and has more than 30 years’ experience as an environmental lawyer across Australia. Since that time he has pursued a strong interest in environmental protection and better environmental laws through positions in the State and Commonwealth public sector and as a parliamentary researcher for the Greens (WA). She is a committee member of the National Environmental Law Association (WA Chapter) and has a potent interest in environmental law and public interest litigation. She has done remarkable work in building alliances across all community sectors and in the maximum remote communities of outback Western Australia. He was an energetic supporter of the establishment of the EDOWA in the 1990’s and has been involved with the EDP throughout most of its 20 year history. Supported by a powerful team of volunteers, we are active hard to protect the WA environment. Through his professional legal experience, Deccan has a detailed understanding of all aspects of environmental law, including environmental impact assessment, water management, biodiversity conservation, climate change, Aboriginal heritage, mining and land access, and human rights. We offer legal services which aim to profit the community. Legal Services to keep the Environment. EDOWA provides legal advice on matters of public interest environmental law. In addition to providing legal advice and litigation in public interest environmental matters, EDOWA also conducts community legal education workshops and presentations. We actively engage in environmental policy and law reform in WA and across Australia. EDOWA provides release legal advice on matters of public interest environmental law. The matter must relate to an environmental issue and be in the public interest. To determine whether the matter is in the public interest the subsequent should be considered: Is the matter being raised primarily for the profit of more than one person? Does the matter donate an opportunity to set a skillful precedent that would profit many other people in similar or comparable circumstances? Is providing legal assistance the only way (or the most efficient way) to resolve the issue? Would organizations other than the EDP be better placed to aid (Ag: because of their expertise)? Does the person represent other people (including members if the person is a body corporate)? Does the apparent legal ground(s) of the complaint (such as a ground of review) itself raise a matter of general or environmental protection (such as a right to be consulted, or taking into consideration environmental issues in granting a land use approval), or does it hoist some other (e.g. The impact on the EDP’s resources may also be considered, and in particular: the amount of resources needed to resolve the matter. Where an owner or occupier of land seeks legal advice concerning a development which has or will have an effect on the value of that person’s land or on Fisher enjoyment of that land, the request for legal advice will not be accepted unless there is a substantial public interest in doing so. Advice should not be provided concerning legal liability for contaminated sites unless there is a substantial public interest in doing so. Where it is obvious from the application for legal assistance that to aid would require the EDP to engage in litigation, the Principal Solicitor can consider providing litigation assistance.
